1. Introduction

These SMS Terms & Conditions (“Terms”) govern your use of text messaging services provided by Eric Lawrence Frazier, operating EricFrazier.com and ThePowerIsNow.com. By providing your mobile number or opting in to receive text messages, you agree to these Terms, as well as the TPIN Media Privacy Policy and all additional policies incorporated by reference.

2. Consent to Receive Text Messages

When you submit your mobile number through any TPIN Media form, verbally provide your number, send a keyword-based opt-in message, or otherwise grant permission, you consent to receive text messages from the following numbers: (714) 475-8629, (800) 401-8994, and (800) 261-1634. These communications may include appointment information, customer service responses, account-related notifications, confirmations, or updates related to your inquiries. Consent is not required as a condition of purchase.

3. Message Frequency and Carrier Rates

Message frequency varies depending on the nature of your inquiry and your interaction with TPIN Media. Standard message and data rates may apply according to your mobile carrier plan. TPIN Media is not responsible for carrier fees, limitations, or delivery restrictions imposed by your carrier.

4. How to Stop Receiving Messages

You may withdraw your consent to receive text messages at any time by replying STOP to any text message sent by us. Once a STOP request is received, your number will be immediately placed on a do-not-text list, and no further messages will be sent unless and until you provide renewed express written consent. TPIN Media does not share, sell, rent, disclose, or transfer mobile phone numbers, SMS consent records, or SMS messaging data to any third party for marketing or promotional purposes. Mobile numbers and SMS consent information are used solely for transactional communications and customer care.

7. Opt-In Methods

You may opt in to receive text messages through website forms requiring you to check a consent box, through paper forms where you provide written consent, through verbal consent for non-marketing communications, or through sending a keyword to one of our SMS numbers. Opt-in consent is recorded through timestamp, IP address, or form submission records consistent with applicable law.

8. Accuracy of Information

You represent that the mobile number provided belongs to you and that you are authorized to receive messages at that number. You agree to notify TPIN Media if your number changes or is reassigned.

9. Revocation of Consent Not a Condition for Other Services

Withdrawing consent to receive SMS messages does not affect your ability to use TPIN Media websites, advisory services, or consulting engagements. It only stops text message communications.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Riverside County, California.
